தேர்தல் ஆணையம், உச்சநீதிமன்றமும் வாக்காளர்கள் ஆணையும் அமைக்குமா?Will the Election Commission, the Supreme Court and the Voters’ Commission be established?

காட்டுமன்னார்கோயில் எம்எல்ஏ சிந்தனை செல்வன் உண்மையிலே அறிவாளி, அவர் நீதித்துறையை பற்றி பல அடுக்கடுக்கான குற்றச்சாட்டுகளை எடுத்து வைத்துள்ளார்.

அதாவது அவர் சொல்வது, நீதித்துறையில் வெளிப்படைத் தன்மையில்லை. மேலும்,நீதிபதிகள் தீர்ப்பு தான் சொல்ல வேண்டுமே ஒழிய, கருத்து சொல்லக்கூடாது என்று உச்ச நீதி மன்றமே தெரிவித்துள்ளது என்று தெரிவிக்கிறார். தவறில்லை.

அடுத்தது, நீதித்துறையின் அரசியலமைப்பு சாசனத்திற்கு எதிராக கருத்து சொல்கிறார்கள். இங்கே, ஒவ்வொரு மனிதனுக்கும் ஒரு கருத்து இருக்கிறது. அது நல்லதாகவும் இருக்கலாம், கெட்டதாகவும் இருக்கலாம். ஆனால் பொதுவான கருத்து மட்டும் தான் ஏற்றுக் கொள்ளப்பட வேண்டிய ஒரு விஷயம். தவிர,நியாயமான கருத்து எதுவோ, அது எல்லோராலும் ஏற்றுக் கொள்ளப்பட வேண்டிய ஒன்று.

அதே போல் தான் இந்த எம்எல்ஏ பேசியது நீதித்துறைக்கு ஆணையம் அமைக்க வேண்டும் என்று வலியுறுத்தி இருக்கிறார். சட்டமன்றத்திலே ஒரு எம்எல்ஏ இவ்வாறு பேசியிருப்பது மிகவும் வரவேற்க வேண்டிய ஒன்று தான். ஏனென்றால், அந்த அளவுக்கு அவருடைய நேர்மை வெளிப்படுத்தத் தன்மை நீதித்துறையில் வேண்டும் என்று வலியுறுத்தி பேசியிருக்கிறார். ரொம்ப சரியான கருத்து.

இதை நமது தமிழக முதல்வர் ஸ்டாலின் நீதித்துறைக்கு ஒரு ஆணையும் அமைப்பது எவ்வளவு முக்கியமானதோ ,அதே அளவுக்கு வாக்காளர்கள் ஆணையம் அமைப்பது முக்கியமானது. ஏனென்றால் வாக்காளர்கள் வாக்களித்து விட்டால், பதவிக்கு வந்தவர்களை 5 வருடம் எந்த கேள்வியும் அவர்களை கேட்க முடியவில்லை .அவர்கள் மீது எந்த புகார் அளித்தாலும், அவர்களுடைய அதிகாரத்தை எதிர்த்து வாக்காளர்களால், ஒரு சட்ட நடவடிக்கையோ, அல்லது நீதிமன்றத்தில் வழக்கு தொடரவோ உடனடியாக எதுவும் செய்ய முடியவில்லை.As important as it is for our Tamil Nadu Chief Minister Stalin to set up a commission for the judiciary, it is equally important to set up a voters’ commission. மேலும்,எத்தனை மந்திரிகள், எத்தனை எம்எல்ஏக்கள், எத்தனை லட்சம் கோடி ஊழல் செய்தாலும், வாக்களித்த மக்களால், எந்த கேள்வியும் அவர்களை கேட்க முடியவில்லை. அவர்கள் மந்திரிகளை பார்த்து பயப்பட வேண்டியிருக்கிறது. ஒரு பக்கம் கட்சி என்று அடியாட்களை வைத்துக்கொண்டு மிரட்டுகிறார்கள்.

இன்னொரு பக்கம் காவல்துறையில் உள்ள காவலர்களை வைத்து மிரட்டுகிறார்கள். இதையும் மீறினால் பணத்தை வைத்து மிரட்டுகிறார்கள். அப்போது வாக்களித்தவன் நிலைமை என்ன? அவனுடைய நம்பிக்கை என்ன? வாக்களித்த மக்களின் அதிகாரத்தில் வந்த எம் எல் ஏ ,எம் பி, மந்திரி, போன்ற அதிகாரத்திற்கு வந்தவர்களையும் , அதிகார வர்க்கத்தினரையும், எதிர்த்து மக்கள் ஏன்?சமூகப் பணி செய்யவில்லை என்று கூட கேட்க முடியவில்லை. அது மட்டுமா? அரசியல் தெரியாத கிராமங்களில் அப்பாவி மக்கள் ஓட்டு போட்டு விட்டு எவ்வளவு வேதனைப்படுகிறார்கள்?On the other hand, they threaten people with police officers. If they violate this, they threaten them with money. What is the situation of the person who voted then? What is his faith? Why do people oppose those who came to power and the bureaucrats like MLAs, MPs, ministers, etc. who came to power because of the people who voted? அந்த வேதனை ,ஒரு சாதாரண பஞ்சாயத்து தலைவராக வந்தவர்களையே கேட்க முடியவில்லை. அந்த அளவிற்கு இவர்களுடைய ஆட்டம் இருக்கிறது. மேலும்,எம்எல்ஏ ,எம்பி ,மந்திரிகளை, எப்படி வாக்காளர்கள் கேள்வி கேட்க முடியும்? தவிர,இவர்களில் எத்தனை பேர் வெளிப்படை தன்மையாக நிர்வாகத்தை மக்களுக்கு கொடுத்திருக்கிறார்கள்? அதை இந்த சிந்தனை சொல்வாரா மக்களிடம்? மேலும்,சட்டமன்றத்தில் பேச அதிகார மைக் கிடைத்துவிட்டது.That pain, those who came as ordinary Panchayat leaders could not be heard. அதனால், நீதித்துறையில் நீதிபதிகளை பற்றி விமர்சனம் செய்து விட்டார். அதில் சில உண்மைகள் இருக்கலாம், மறுப்பதற்கு இல்லை .ஆனால் நீதித்துறையில் நீதிபதிகள் சட்டப்படி தான் அவர்கள் தீர்ப்பு சொல்ல முடியும். அதை விமர்சனம் செய்வது தவறு. நீதித்துறையில் தவறுகள் இருக்கிறது இல்லை என்று மறுப்பதற்கு இல்லை. ஆனால்,So, he criticized the judges in the judiciary. சனாதனத்திற்கு எதிராக கருத்து சொல்ல வேண்டும். அல்லது தீர்ப்பு சொல்ல வேண்டும் என்று திமுக உள்ளிட்ட எதிர்க்கட்சிகள் அரசியல் செய்வதற்கு சாதகமாக தீர்ப்பு சொல்ல வேண்டும் என்றால், நீதிபதிகள் நீங்கள் வைத்த அதிகாரிகள் இல்லை. If you want to express an opinion against Sanatan or give a verdict in favor of opposition parties including DMK to do politics, then the judges are not the authorities you have appointed.

மேலும், ஒரு இந்து கடவுளை அந்த நம்பிக்கையில் வாழ்கின்ற மக்களை, அந்த மக்களின் வழிபாட்டுத் தலங்களை, அரசியல் ஆக்கி, அரசியல் கட்சிகள் அரசியல் ஆதாயம் தேட நினைப்பது, மக்கள் அரசியல் தெரியாத முட்டாள்களாக இருக்க வேண்டும் என்று நினைப்பது எம் எல் ஏ வின் தவறு.Furthermore, it is the MLA’s mistake to politicize a Hindu god, the people who live in that faith, and the places of worship of those people, so that political parties can seek political gain, and to think that people should be stupid and ignorant of politics.

அதனால், தமிழக முதல்வர் அல்லது பிரதமர் நரேந்திர மோடி வாக்காளர்களின் ஆணையத்தை உருவாக்கி ,வாக்களிக்கும் மக்களின் உரிமையை பாதுகாக்க வேண்டும் என்பதுதான் மக்கள் அதிகாரம் பத்திரிகையின் சார்பில் கோரிக்கை.Therefore, the demand of the MAKKAL ADHIKARAM newspaper is that the Chief Minister of Tamil Nadu or Prime Minister Narendra Modi should form a Voters’ Commission and protect the right of the people to vote.

மேலும், நீதித்துறையே இல்லையென்றால், இந்த அரசியல்வாதிகளை ஏன் ?என்று கேட்க கூட ஆள் இல்லை. நீதித்துறையே இல்லை என்றால் இவர்களுடைய அராஜகங்கள், அட்டூழியங்கள் எல்லை மீறிப் போய்க் கொண்டே இருக்கும் .அதை கேட்பதற்கு நீதிமன்றம் ஆவது இருக்கிறதே என்று ஒரு ஆறுதல் அடைய வேண்டியதுதான். மேலும்,நீதிமன்றத்தால் கூட இன்னும் சரியான தண்டனை பதவியில் இருப்பவர்களுக்கு வழங்க முடியவில்லை சட்டங்கள் கடுமையாக்கப்பட வேண்டும் என்று தொடர்ந்து மக்கள் அதிகாரம் பத்திரிகை குரல் கொடுத்து வருகிறது .Moreover, if there is no judiciary, why do these politicians do this? There is no one to ask. If there is no judiciary, their anarchy and atrocities will continue to go beyond the limits. It is a comfort to know that there is a court to hear it. Moreover, even the court has not been able to give the right punishment to those in power. The MAKKAL ADHIKARAM newspaper has been continuously raising its voice that the laws should be tightened.

இதுவும் இல்லையென்றால் இவர்களை ஏன் என்று கேட்பதற்கு கூட ஆள் இருக்காது. இதில் உள்ள ஓட்டை சட்டங்களை பயன்படுத்தி ஊழல்வாதிகள், கிரிமினல்கள் தப்பித்து கொண்டிருக்கிறார்கள் .If this were not the case, there would be no one to even ask them why. ஆனால், ஆண்டவனின் சட்டங்களில் ஒருவரும் தப்பிக்க முடியாது .அங்கே பணக்காரன், ஏழை ,பதவி, அதிகாரத்தில் இருப்பவர்கள் என்ற பாகுபாடு கிடையாது. அங்கே எல்லோருக்கும் ஒரே சட்டம், ஒரே நியாயம், ஒரே நீதி,ஒரே தண்டனை.

அப்படிப்பட்ட கடவுளின் இடத்திலே உங்களுக்கு அரசியல் செய்ய அதிகாரம் இருக்கிறது என்றால்! வாக்களித்தவனுக்கு அவன் வணங்கக்கூடிய தெய்வத்தை பற்றி கேட்கக்கூடிய உரிமை இல்லையா?If you have the power to do politics in the place of such a god! Doesn’t the voter have the right to ask about the god he worships?
